Understanding Your Ownership Options

If there is more than one purchaser, you will need to decide how you would like to hold the property. There are two options:

Joint Proprietors

Each owner holds an equal share in the property. If one owner passes away, their share automatically passes to the surviving owner/s regardless of what any Will says. This is the most common option for couples purchasing a family home.

Tenants in Common — Equal Shares

Each owner holds an equal share in the property (e.g. 50/50). If one owner passes away, their share passes to the beneficiaries of their estate or the persons named in their Will — it does not automatically pass to the other owner. This option is common for friends, siblings, or business partners purchasing together.

Tenants in Common — Unequal Shares

Each owner holds a specified share in the property that does not have to be equal (e.g. 60/40 or 70/30). The same rules apply as Tenants in Common above — each owner's share passes according to their Will or estate. If you select this option, you must advise us of the exact shares separately. This option is common where purchasers have contributed different amounts to the purchase.

Pre-Settlement Protection — Purchaser's Caveat

A caveat is a legal document that records your interest in a property on the title. It acts as a warning to others that you have a claim over that property.

Once you have signed a Contract of Sale, lodging a caveat protects your interest in the land prior to settlement. It ensures your interest is recorded as a priority over other parties who may seek to register an interest in the same property.

Once settlement takes place, the caveat will automatically lapse as your ownership will be formally registered on title.

Our fee is $330.00 including GST, plus disbursements, payable at settlement.

Important — Next Steps After Submission

Once we have reviewed your purchase instructions, you will receive a separate email from InfoTrack containing your identity verification and client identification forms. Please allow 24–48 hours from submission for this email to arrive.

To avoid any delays, please ensure you have the following ready when you receive that email:

Australian driver's licence or passport
Medicare card (if required as a secondary document)
Current residential address
Details of how you are funding the purchase (e.g. lender name, or source of cash funds)

I/we authorise EMConvey Pty Ltd to act on my/our behalf in connection with this matter, including signing and lodging documents electronically via PEXA, in accordance with the terms of the Cost Agreement accepted via Perfect Portal.
I/we have read and agree to be bound by the Cost Agreement and Costs Disclosure provided to me/us via Perfect Portal, and I/we understand that EMConvey Pty Ltd's engagement is conditional upon acceptance of those terms.

Cyber Safety and Bank Account Verification

I/we acknowledge that EMConvey Pty Ltd will never send bank account details by email alone. Before transferring any funds, I/we will independently verify account and BSB details by telephone using a number sourced independently of the email or communication containing those details.
I/we understand that if I/we receive any communication that appears to be from EMConvey Pty Ltd requesting a change to bank account details, I/we will contact our office immediately before taking any action.
I/we acknowledge that EMConvey Pty Ltd cannot be held responsible for any loss arising from a failure to verify bank account details prior to transferring funds.

Electronic Settlement

I/we understand that this matter will be settled electronically via PEXA and that once the PEXA workspace is locked and financial settlement occurs, the transaction cannot be reversed or unwound.
I/we understand that it is my/our responsibility to ensure that all funds required for settlement are available and that any shortfall may result in a delay to settlement for which penalty interest may be charged by the vendor.

Identity Verification and AML/CTF Compliance

I/we understand that identity verification and client identification forms will be sent to me/us separately via InfoTrack within 24–48 hours of submitting this form, and that work on my/our file cannot commence until those forms have been completed.
I/we acknowledge that providing false or misleading information in connection with our engagement may constitute an offence under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth).
