The Stamp Duty exemption, explained simply
Here’s the good news: a property transfer made because a marriage or de facto relationship has ended, between the two people in that relationship, under a sealed Court Order or a valid Binding Financial Agreement, can be exempt from stamp duty in Victoria.
It isn’t automatic – it depends on a properly sealed Order or Agreement, the correct Digital Duties Form, and complete supporting documentation. Get a detail wrong, and that exemption can be lost. Making sure that doesn’t happen, and that the property side of your settlement is handled correctly, is exactly the kind of detail we take care of.
